By accessing or using our website and services, you ("Customer," "Client," or "you") agree to be bound by these Terms. Please read them carefully.
1. Scope of Service
A. Service Provided: We agree to provide non-hazardous junk removal, hauling, and disposal services as scheduled and agreed upon with the Customer. This may include the removal of trash, debris, furniture, appliances, and other non-hazardous items.
B. Excluded Items: We reserve the right to refuse to remove any item that is deemed hazardous, toxic, illegal, or potentially harmful to our employees, equipment, or the environment. This includes, but is not limited to: chemical waste, medical waste, biological waste, paint, asbestos, and certain regulated materials. If hazardous materials are discovered on-site, the job may be paused or canceled, and a trip charge may still apply.
C. Final Price Determination: The quote provided initially (via phone, email, or online) is an estimate. The final price is determined on-site by our team based on the actual volume, weight, labor required, and accessibility of the items to be removed. The Customer must approve the final price before any work begins.
2. Customer Responsibilities
A. Access and Authorization: The Customer guarantees that they are the owner of the property or have the full authority and permission from the owner to authorize the removal of all materials from the specified location.
B. Preparation: The Customer is responsible for clearly identifying and separating all items to be removed. We are not responsible for removing or disturbing items not designated for removal.
C. Safety and Clearance: The Customer must ensure that our team has clear, safe, and unobstructed access to the materials. If any materials require special access (e.g., locking gates, specific time windows), the Customer must notify us in advance.
3. Damage and Liability
A. Damage to Property: While our teams take reasonable precautions to avoid property damage, the risk of damage exists, especially when removing large or heavy items. We are responsible for damage caused by gross negligence or willful misconduct of our employees.
B. Customer Indemnity: The Customer agrees to hold Get It Gone ASAP harmless and indemnify us against all claims, liabilities, costs, and expenses arising from the removal of items, including, but not limited to, damages arising from hidden hazards or misidentified property boundaries.
C. Final Inspection: The Customer (or an authorized representative) must be present for a final walk-through and inspection immediately upon job completion. By signing the work order or allowing the team to depart without registering a complaint, the Customer affirms that the service was completed satisfactorily and that no property damage occurred. Any claims for damage must be reported to the team leader before they leave the property.
4. Payment, Billing, and Guarantee
A. Payment Terms: Payment for the service is due in full immediately upon completion of the job. We accept Credit Card, Cash, or Check.
B. Non-Payment: If payment is not received at the time of service, we reserve the right to apply late fees, collect outstanding balances through legal means, or use collection agencies. The Customer shall be responsible for all costs of collection, including reasonable attorney fees.
C. 100% Satisfaction Guarantee: Our commitment is simple: You will be satisfied with the service provided, or you don't pay for the service. This guarantee must be invoked before our team leaves the property and applies only to the quality of the service provided, not to the pre-approved final price.
5. Website Use
A. Copyright and Intellectual Property: All content on getitgoneasap.com, including text, graphics, logos, and images, is the property of Get It Gone, LLC and is protected by copyright laws.
B. Accuracy of Information: While we strive for accuracy, we do not warrant that the content on this website is free of errors, omissions, or inaccuracies.
6. General Legal Provisions
A. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles.
B. Dispute Resolution: Any dispute arising out of or related to these Terms or the Service shall be subject to binding arbitration in Washington, except for claims for injunctive relief.
C. Changes to Terms: We reserve the right to update or change these Terms at any time. The updated Terms will be posted on this page and will take effect immediately. Continued use of the Service constitutes acceptance of the revised Terms.
